Can the investor use the original opening schedule for the second location’s E-2 preparation?

THE DIRECT ANSWER

Use current transaction and operating dates. A historic schedule does not establish that new premises, funds or personnel are ready.

Update dependencies before relying on the prior plan

Identify when rights to the location arise and what activities are proposed before and after opening. Preserve material changes in ownership or responsibilities for procedural assessment. An expansion deadline does not automatically extend current immigration authorization or guarantee a decision. The filing account should describe the present proposal rather than the timetable of the first location.

Obtain an executed amendment, verify that any closing conditions have occurred, update the ownership ledger and resolutions, and align the business plan with the operative governance terms. A purchase conditioned on E-2 visa issuance may still meet the commitment requirement when the funds are placed beyond the investor's control in a binding escrow for release to the seller once the visa is issued. An escrow whose only outstanding condition is issuance of the visa is accepted in official guidance as a solid, irrevocable commitment, while one the buyer can unwind for reasons of their own has preserved the funds rather than committed them.
