Start with the L-1B eligibility and application overview
Identify the organization-specific knowledge
L-1B covers special knowledge of the organization’s products, services or other interests and their application in international markets, or advanced knowledge of its processes and procedures. Describe the actual internal implementation, decisions and responsibilities. General familiarity with a commercial platform does not by itself establish the required knowledge.
Explain the certificate’s real evidentiary role
State what the vendor assessed and what the applicant learned, then identify the employer-specific evidence beyond that qualification. Do not claim that every externally taught skill is disqualifying or that all knowledge must be unique or proprietary. The record should explain the actual special or advanced knowledge and its use in the proposed U.S. work. If primarily stationed at an unaffiliated worksite, the employee cannot be principally controlled and supervised by that employer, nor placed essentially as labour for hire rather than in connection with the petitioner’s specialized-knowledge product or service.
Establish the qualifying transfer independently
The organizations need a qualifying parent, subsidiary, affiliate or branch relationship and the required continuing business in the United States and another country. Prove the qualifying continuous year of full-time foreign employment within the relevant three-year period. A vendor’s customer relationship with the employer is not automatically a qualifying corporate relationship, and a certification date is not the full employment record. That foreign year must be full-time qualifying managerial, executive or specialized-knowledge employment; the U.S. role must use specialized knowledge.
Apply office, ownership and stay conditions
Ordinary individual initial L-1B approval may be up to three years and the general maximum is five years, with applicable counting and exceptions. A qualifying U.S. organization doing business for less than one year triggers new-office rules: sufficient premises, financial ability to pay the beneficiary and commence business, and an initial limit of one year. Owner or major-stockholder cases also require the appropriate temporary U.S. services and subsequent foreign-assignment evidence.
Specialized knowledge means the company's, not the industry's
What makes the knowledge special is the company's own protocol: the sequence, the concentrations, the tolerances and the diagnostic decision tree developed from its own installed base and failure history. General industry expertise alone is not a complete account, and uniqueness or proprietary ownership should not be imposed as a universal standalone test. Set out who assigns the work, who supervises it, who pays whom, and how the specialized knowledge is applied at the third-party location. Compare the claimed knowledge with what a skilled worker in the industry would ordinarily know, using the company’s own process or product evidence where possible. What supports the petition is knowledge tied to something the organization itself created or developed: internal specifications, a proprietary configuration, a method documented only inside the company, or an equipment adaptation that does not exist elsewhere. Training records, dated process material, examples of unusual problem-solving and evidence of the knowledge’s value to the U.S. operation are more useful than a statement that the employee is simply experienced or trusted.
