Read the general immigrant investor briefing overview
A hypothetical Leduc applicant may review an EB-5 proposal based on an existing business’s expansion while also considering Gold Card. Identify the actual statutory route and transaction instead of assuming that a growing business and a large payment produce the same immigration result.
Examine the EB-5 enterprise and investor requirements
Where the regulatory expansion route is used, the relevant change is at least 40% in net worth or employees, reaching at least 140% of the pre-expansion level; this is not a universal growth requirement for every case. Current general capital thresholds are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustments beginning January 1, 2027. Lawful at-risk capital, at least ten qualifying permanent full-time jobs per investor and managerial or policy engagement remain necessary.
Read the Gold Card payment and eligibility terms
Current official terms require US$15,000 nonrefundable processing per person and, after successful vetting, a US$1 million individual principal gift or US$2 million gift per corporate-sponsored employee. Each intended eligible joining spouse or unmarried child under 21 adds US$15,000 and US$1 million, including corporately, with initial inclusion recommended. Corporate terms include 1% annual maintenance and 5% transfer with a new background check; replacement approval is not automatic. Gold Card uses EB-1 or EB-2 as appropriately determined, subject to eligibility, admissibility and visa availability.
Preserve evidence and the later milestones
For foreign-language documents submitted to USCIS, provide the required full English translation and certification rather than a selective synopsis. That procedural requirement does not establish the underlying facts for either route. EB-5 petition approval is not residence; I-829 is generally filed in the 90 days before conditional residence’s second anniversary. Neither an expansion announcement nor a gift confirmation grants present work permission or guarantees the final decision. Conditional residence begins at immigrant admission or adjustment approval, not at investment or petition approval.
