Operational urgency does not itself authorize U.S. employment or remove the L-1 requirements. Use the actual available process and permission before beginning the proposed work.
Keep the response plan lawful and realistic
A business can identify the knowledge it needs without promising an approval date. Confirm the qualifying employment, corporate relationship and role, and plan around the applicable decision and admission steps. An internal emergency designation does not suspend the initial or maximum stay rules.
Time already spent in the United States in certain employment-based statuses can count toward the limit, and the group should establish the remaining balance before promising anyone a longer stay. An L-1B placement primarily at an unaffiliated worksite must remain principally controlled and supervised by the petitioner and provide a petitioner-specific product or service requiring specialized knowledge rather than labour for hire. The beneficiary must also have completed one continuous year of qualifying employment abroad with the group within the preceding three years, which should be verified from payroll at the start rather than assumed.
