Can a donation to a U.S. public project automatically satisfy the Gold Card gift requirement?

THE DIRECT ANSWER

No such substitution should be assumed. Follow the actual Gold Card instructions and identify the required recipient and transaction.

Distinguish public benefit from the immigration payment

A worthwhile public purpose does not itself establish the Gold Card process. The applicant still needs the appropriate EB-1 or EB-2 eligibility, admissibility and visa availability. Do not turn a project’s acknowledgement of support into a government immigration approval.

The official Gold Card page presents a sequence of application and processing fee, vetting, further instructions and gift, followed by permanent residence through an existing employment-based category as determined by the authorities and subject to visa availability. Speed in immigration is produced by specific mechanisms: premium processing where a category offers it, port-of-entry adjudication where a classification permits it, or an expressly expedited process. Criminal history, prior immigration violations, misrepresentation and health-related grounds are assessed under the general rules, and an applicant with a complication in any of those areas should get that assessed before considering a program whose principal cost is a payment. Disclose the requested citizenship and identity information accurately and review visa availability for the actual case rather than assuming residence or a second passport changes the queue.
