An L dependent child does not receive the employment authorization available to qualifying L spouses. The employer’s invitation does not create separate permission.
Keep participation and employment distinct
Eligible children must be unmarried and under 21 for the ordinary dependent category. Identify what the proposed assistance involves and the child’s actual status. A school connection, family relationship or small payment does not itself authorize work. Qualifying L spouses may work incident to valid status with appropriate evidence, but that rule should not be transferred to children.
The principal must independently establish a qualifying related organization, an uninterrupted year of foreign employment during the applicable three-year period, and company-specific special or advanced knowledge needed for the U.S. role. L-1B requires qualifying organizations doing business, twelve continuous months of qualifying employment abroad during the relevant preceding thirty-six months, and specialized knowledge for the U.S. assignment. The practical consequence of the FAM position is that dependent periods must be provable rather than merely asserted: keep the dependent approval or the record of admission showing the classification, not simply a recollection that the family travelled together.
