THE SHORT ANSWER

A Devon household may arrange schooling while a child is also invited to assist the principal’s employer. Identify the actual activity before assuming that an educational connection determines its immigration treatment.

01

Use the child’s own dependent conditions

The ordinary dependent relationship concerns an eligible spouse or unmarried child under 21. TD, E and L dependents may study while maintaining status, but enrolment does not extend that status. TD does not authorize employment; L and E dependent children do not receive the work authorization available to qualifying spouses. Immigrant CSPA does not extend temporary dependent eligibility.

02

Describe the proposed company activity

Identify the duties, location, payment and relationship to the school program without relying only on terms such as internship or family help. The parent’s approval and the company’s invitation are not the child’s work authorization. Assess any appropriate independent permission before building the activity into a school or relocation schedule.

03

Maintain separate family records

Qualifying E and L spouses may work incident to valid status with appropriate evidence, but the actual spouse classification and dates matter. An EB-5 petition or Gold Card payment does not grant current residence or permission to work. For immigrant-visa derivatives, follow the principal-first-or-together entry sequence and assess child-age issues using actual case dates.
