THE SHORT ANSWER

A Devon employer may discuss hiring workers for an EB-5 enterprise and sponsoring employees under the corporate Gold Card framework. These are different legal and financial roles; a headcount should not migrate from one proposal into the other without explanation.

01

Prepare two different employee records

For the EB-5 enterprise, identify each proposed qualifying permanent position, its duties, hours and actual employment evidence. For corporate Gold Card, identify each named person the company proposes to sponsor. Do not assume these are the same roster or that an employee appears in one because they appear in the other. A planned contractor conversion should remain a planned change until the underlying employment facts support the account. Assign someone to update both records when hiring or sponsorship plans change.

02

Test the EB-5 employment and capital evidence together

EB-5 requires at least ten qualifying permanent full-time jobs per investor using the applicable direct or regional-center method. A direct position needs at least 35 weekly hours; contractors, nonimmigrants, the investor, spouse, sons and daughters are excluded from qualifying employees. A job offer alone should not be described as proof of an existing qualifying position. The required capital is currently US$1,050,000, or US$800,000 for a qualifying TEA or infrastructure project, with statutory adjustments beginning January 1, 2027. Establish lawful at-risk funds and managerial or policy-formulation participation rather than treating payroll plans as the complete investment assessment.

03

Compare the enterprise agreement with the sponsorship budget

Read EB-5 repayment provisions and side letters even when the staffing plan appears sound. Contractual repayment rights and guaranteed rates of return are excluded. The narrow enterprise-only discretionary option requires petition withdrawal on exercise unless sustainment and the other statutory requirements are fulfilled. Gifts or loans also need lawful-source evidence and a good-faith arrangement that does not circumvent permissible-source restrictions. Corporate Gold Card has a different destination for funds: after vetting and instructions, the published government gift is US$2 million per sponsored employee, compared with US$1 million for an individual principal. Processing is US$15,000 nonrefundable per person. Each intended eligible joining spouse or unmarried child under 21 adds a US$1 million gift and processing, including corporate cases; initial inclusion is recommended. Corporate obligations include 1% annual maintenance and 5% transfer with a new background check, not automatic approval of a replacement employee.

04

Keep employment starts distinct from immigration decisions

Check the actual permission for each person before assigning a U.S. work date. Corporate sponsorship does not automatically make a person a qualifying direct EB-5 employee, and neither an offer nor payment supplies current work authorization. Gold Card proceeds through the applicable EB-1 or EB-2 assessment, including eligibility, admissibility and visa availability. EB-5 conditional residence instead starts at immigrant admission or adjustment approval; I-829 is generally filed in the 90 days before its second anniversary. A principal’s petition approval is not residence or permission for every member of the household. Maintain the people and position records through these separate milestones rather than adopting one company-wide moving date.

A CONVERSATION IS A GOOD PLACE TO START.
