Does satisfying an enterprise-expansion measure reduce the required EB-5 investment amount?

THE DIRECT ANSWER

No automatic reduction follows. Apply the actual current capital threshold and any valid qualifying basis separately.

Keep establishment and capital tests distinct

General current amounts are US$1,050,000 or US$800,000 for a qualifying targeted employment area or infrastructure project, with statutory adjustment beginning January 1, 2027. The expansion route does not itself create a discounted threshold or waive at least ten qualifying permanent full-time jobs per investor. Private business costs and official charges also need separate treatment.

Build a single schedule listing the qualifying capital, administrative fees, independent legal fees, financial review, translation, medical examinations, and travel, with the payee and timing beside each. The petition to remove conditions is a substantive filing with its own government fee on the current schedule and its own evidentiary burden, and where a project's performance is disputed it can require economic analysis and legal work well beyond the initial process. Verify current government amounts officially rather than relying on figures quoted in older material, and treat any promise of a particular outcome as a warning sign rather than as a reassurance about value for money.
