Review the revised role rather than relying on the original delegation.
Use the current governance record
Identify which decisions moved to others and what the applicant now primarily does. A material change may affect the requested classification. For new-office L-1A, preserve the specific foreign managerial or executive year and the requirement to support the U.S. role within one year of approval.
Ask for four dates in writing: when the applicant's employment with the current entity began, when any transfer of the business unit takes legal effect, when employment with the receiving entity begins, and when the filing or the intended admission would occur. L-1A requires qualifying organizations that are doing business, a managerial or executive U.S. position, and twelve continuous months of qualifying employment abroad during the relevant preceding thirty-six months. Work backwards from the season the U.S. operation is meant to serve, allow for a request for further evidence, and put the twelve-month extension review in the calendar on the day the first petition is filed rather than eleven months later. Keep monthly records from opening day so the second petition is a report on an operation rather than a revised prediction, and note the seven-year overall limit for L-1A when the household plans further ahead.
