Prepare an executive’s new-office authority and resources

THE SHORT ANSWER

A new-office proposal should explain both the executive’s authority and the operation that will support the role.

01

Identify the business stage

The first thing to settle is which framework the petition sits in, because the evidence changes with the answer. An entity that has been doing business in the United States for under a year is treated as a new office, and doing business means the regular, systematic and continuous provision of goods or services, not the mere existence of a corporation. A certificate of incorporation, a registered agent and a bank account opened in advance prove formation, not trading. Look instead for what the entity has actually done: invoices raised, contracts performed, payroll run, a lease signed, tax filings made. Getting this right early matters because the new-office route carries its own extra requirements and its own shorter first approval, and a petition assembled on the assumption that the entity is already established will be missing exactly the evidence the new-office branch asks for. One of those extra requirements decides cases: where a new office seeks an L-1A beneficiary whose United States duties will be primarily managerial or executive, the qualifying year abroad must itself have been managerial or executive work, and a year of specialized-knowledge work will not satisfy that test even though the same year would qualify a transfer into an established office.

02

Explain authority within the organization

An executive claim is a claim about decision rights, so describe them concretely. Set out which goals and policies this person sets rather than receives, what they may commit the company to without asking anyone, what budget and hiring authority sits with them, and where the boundary of the board's oversight actually falls. Wide discretion supervised only at the level of general direction supports the claim; a role that clears each material decision with a parent-company committee does not, whatever the job title says. The proposal also has to show the operation that will carry the role. That means premises sufficient for the business described, and a credible account of how, within one year of approval, the operation will support duties that are primarily executive rather than the founder personally performing sales, delivery and bookkeeping. Present planned delegation as a plan with dates, funding and recruitment behind it, never as an arrangement that already exists, and do not treat a compensation package or an equity holding as proof that the work is executive.

03

Keep L-1B and the common conditions visible

Two further sets of conditions have to remain visible in the file. For a new office seeking L-1B, the petitioner shows premises sufficient for the business together with the financial capacity to pay the beneficiary and to begin operations, and it still has to establish specialized knowledge of that company's product, service, research, equipment, techniques or management, or an advanced level of knowledge of the organisation's processes and procedures, rather than a skill that is simply common in the wider labour market. Whichever branch is used, a first new-office approval runs for no more than a year. Underneath that sit the requirements common to every L petition: a qualifying parent, branch, subsidiary or affiliate relationship between the two entities; both of them doing business regularly and continuously in the United States and in at least one other country; and one continuous year of full-time qualifying employment abroad falling within the three years before the petition. Foreign employment in an ordinary transfer may be managerial, executive or specialized-knowledge work, while the American role has to meet whichever classification is being requested. Days the employee spent inside the United States do not count toward the foreign year, though short visits do not by themselves break its continuity. Build the record for the extension as the year runs, because the first decision guarantees nothing about the second.
