A Strathcona County specialist recently completed internal training on an advanced process. The preparation question is what the applicant can actually do and how that knowledge fits the U.S. assignment, rather than whether attendance alone supplies L-1B eligibility.

Start with the L-1B eligibility and application overview

01

Distinguish attendance from applied knowledge

Explain the process, the applicant’s prior experience and concrete use of the training. Identify what is advanced or special in the relevant organizational context. Do not claim that a short recent course proves every aspect of the knowledge standard or the qualifying foreign employment year. Separate the learning record into what the applicant knew before the course, what the course covered and what the applicant has actually applied afterward. Link any claimed practical capability to a relevant example rather than assuming attendance proves mastery. If the applicant will need further instruction for the proposed U.S. duties, identify it honestly. Explain the organizational context that makes the relevant process special or advanced; do not use the recent completion date as evidence of uniqueness. This also keeps the qualifying employment chronology accurate: a certificate records a training event, while employment and duty records must establish the relevant work period. Neither record should silently take the place of the other.

02

Apply the knowledge and employment conditions

L-1B covers special knowledge of the organization’s products, services, research, equipment, techniques, management or other interests and their international application, or advanced knowledge of its processes and procedures. Knowledge need not be unique or proprietary. A U.S. organization doing business for less than one year needs sufficient premises and financial ability to pay the beneficiary and commence business; initial new-office approval is at most one year. Owners or major stockholders also need temporary-services and subsequent foreign-assignment evidence. Establish a qualifying parent, subsidiary, affiliate or branch relationship, continuing regular business in the United States and at least one other country, and one continuous full-time qualifying foreign year within the relevant preceding three years. Ordinary foreign work may be managerial, executive or specialized knowledge; the U.S. role must meet the requested classification. U.S. visit days do not count toward the foreign year, although brief visits do not automatically break continuity.

03

Examine the proposed site and duties

At a principally unaffiliated worksite, L-1B is barred if that employer principally controls and supervises the employee, or the placement is essentially labour for hire rather than tied to the petitioner’s specialized-knowledge product or service. Match the claimed knowledge with the actual work rather than an anticipated future role the applicant has not yet been assigned.

04

Sort general skill from company-specific knowledge

Specialized knowledge does not have to be unique worldwide, and the inquiry is not whether every US worker lacks the skill. A petition that opens with the company’s own asset — a formulation, a drying schedule, a control system built in house, a documented method — and then shows who can operate it tends to describe specialized knowledge. Principally unaffiliated placements require assessment of principal control and supervision and labor-for-hire restrictions versus work connected to the petitioner’s product or service requiring specialized knowledge. The answer should acknowledge that measurement techniques and statistical methods are taught generally, then explain what is company-specific: the fixture designs, the sequencing that suits the company’s particular machines, the acceptance rules negotiated with named customers, and the tribal knowledge captured in the revision notes. If any part of the work will be performed at a reinsurer's or vendor's premises, the petition must show the analyst remains controlled and supervised by the petitioning group and is providing the company's own specialized knowledge, not labour for hire. If the arrangement changed from product implementation to supplying general labour, that distinction should be addressed directly rather than left for an officer to infer. Training materials, controlled-access records and examples of troubleshooting decisions can show what cannot be learned from ordinary industry material.
