Keep household income and the enterprise’s own capacity distinct.
Assess the business and the spouse separately
Explain the enterprise’s qualifying economic capacity rather than assuming an unrelated spouse’s wages establish it. Eligible E spouses generally have work authorization incident to valid spousal status, subject to their own record. Unmarried children under 21 may qualify as dependants but do not receive work permission from E dependent-child status.
List each family member's citizenship, relationship evidence, age, and intended work or study, and treat the spouse's own employment documentation as a separate question from the investor's ability to run the business. If the existing business continues, someone has to manage it while the investor develops and directs the U.S. enterprise, and that person may be a family member whose own plans then change. Until the spouse holds an appropriate work-authorized status, operating machinery, serving customers, or managing inventory in the United States may be employment even when unpaid. Identify the treaty-national investor, confirm that qualifying nationals own at least 50 percent of the enterprise, and document how the principal will develop and direct it through ownership or operational control.
