Eligible E spouses generally have work authorization incident to valid spousal status; ownership is not the source of that permission.
Confirm the spouse’s own position
Check the actual spouse-specific status record before employment. Unmarried children under 21 may qualify as dependants but do not receive employment authorization from E dependent-child status. Business shares and family relationships should not be used interchangeably as evidence of work permission.
If the family intends to relocate while the investor continues to run a Canadian business, be explicit about that with counsel, because it changes both the practical arrangements and the description of who is directing the American enterprise day to day. Note one point that surprises owners: owning the company does not by itself authorize you to perform work in the United States — the authorization comes from your status and its terms, which is exactly what repeated absences can put in question. Explain whether the spouse holds real decision rights and how they affect the principal’s development-and-direction claim instead of using a family title to conceal unresolved control. Families in that position usually look at whether the young adult has an independent basis, at a student route, or at whether an immigrant category should be started by somebody in the family long before the birthday arrives.
