Review the note, guarantees and security documents together. Personal-only secured or unsecured borrowing may qualify under the remaining conditions. Do not classify the loan from its informal label or the asset the applicant considers most valuable.
The valuable work here is judgement: reading the refund clause, deciding which payments count toward the committed total, and testing whether the revised plan still supports a non-marginal enterprise. Build an investment ledger that distinguishes money already spent, funds bound by enforceable nonrefundable obligations, working capital controlled by the enterprise, and merely forecast expenses. E-2 requires lawful funds that are substantial in relation to the business and irrevocably at risk, alongside treaty nationality, qualifying enterprise ownership, and the investor's development and direction through majority ownership or operational control. Keep household expenses separate and review whether the revised funding plan still supports a credible enterprise rather than assuming the purchase price covers everything. Work out the qualifying figure by identifying the borrower, the collateral described in each security instrument, any financing statement filed against the company, and the payment terms; then reconcile the buyer's own cash against the financed balance without counting a dollar twice.
