Do ten signed employment offers start the EB-5 residence clock?

THE DIRECT ANSWER

No. Conditional residence begins at immigrant admission or adjustment approval, not when offers are signed or the business reaches a hiring target.

Track hiring and residence separately

I-829 is generally filed during the 90 days before conditional residence’s second anniversary. The applicable job showing still requires genuine evidence, not an assumption that offers and actual positions are identical. A petition approval, payroll milestone or investment payment does not itself grant current work permission or remove conditions.

The petition must show that the required capital has been contributed or is actively being contributed, which for a regional-center project usually means the funds sit in the project's escrow under terms that release them to the enterprise on filing or approval. Schedule three checkpoints across the conditional period: an early one to agree the evidence list, a midpoint one to test what has been collected, and one roughly six months before the window opens to prepare the filing. Construction milestones affect job creation and the project's own performance, but petition adjudication, visa availability and the appropriate visa or adjustment stage independently determine the immigration timeline. Anchor the immigration side to the milestones the household can observe: the source-of-funds file complete, enterprise documents signed, the petition receipted, and movement in the relevant category and chargeability.
