Does paying the principal’s Gold Card gift cover a spouse who joins later?

THE DIRECT ANSWER

No automatic inclusion follows from the principal’s gift. Eligible joining family members have separate published commitments.

Identify the person and current instructions

Each intended eligible joining spouse or unmarried child under 21 currently adds US$15,000 processing and a US$1 million gift, including corporate cases. Initial inclusion is recommended. Do not treat family scheduling as an exemption from those terms or from eligibility review.

The employment-based immigrant categories include a spouse and unmarried children under twenty-one as derivatives, and it is natural to expect the same pattern elsewhere, but that expectation is an assumption rather than a finding. The program's official description attaches its own processing fee and gift to each accompanying family member, so a sponsored employee's household is not included in the employer's headline commitment unless the agreement says so. Identity and civil documents for every person to be included, a written record of the source of the gift and fee funds, the household's complete immigration and criminal history, and a dated copy of the official instructions. Whether any statutory protection could apply depends on the facts and on the programme's current terms, and it is precisely the kind of question that should be put to a licensed U.S. immigration attorney before a nonrefundable fee is paid for anyone in the household.
