Does a job-sharing plan reduce the EB-5 capital threshold?

THE DIRECT ANSWER

The staffing arrangement does not itself create a lower capital category.

Keep capital and jobs as separate tests

Current capital is US$1,050,000 or US$800,000 for a qualifying TEA or infrastructure project, with statutory adjustments beginning January 1, 2027. Establish at least ten qualifying permanent full-time jobs per investor under the applicable method. Do not treat a shared position as multiple jobs to support the budget.

Budget the Form I-526 filing charge on the USCIS fee schedule, later immigrant-visa or adjustment and removal-of-conditions charges, legal and accounting costs, a business plan and any site analysis, and the tax cost of extracting capital from the Canadian company. Potentially the entire qualifying capital amount difference and processing costs, since an improperly designated investment may not satisfy EB-5 requirements at either amount if the underlying claim was inaccurate. Beside the qualifying amount, list administrative charges, escrow release conditions, legal and accounting fees, transfer costs and, for a direct enterprise, working capital the plan assumes you will supply. Record capital contribution, administrative charges, escrow terms, document services, translations, government filing fees, travel, and later-condition-removal planning in separate columns.
