Start with the L-1A eligibility and application overview
Separate review authority from bookkeeping
Explain responsibility for accounting policies, professional staff, reporting judgments and resource decisions. Identify transaction entry, reconciliation and other operating work the applicant personally performs. A signature on the final report does not alone establish a primarily managerial role. A supported account of delegation is more useful than replacing every task with the verb oversee.
Document the support that exists
A shared-service agreement may identify resources without proving that those people are available for the U.S. operation. Reconcile the agreement, staffing and actual work allocation. For professional subordinates, explain the positions’ professional duties rather than relying only on degrees held by their occupants. No universal team-size quota replaces assessment of the organization’s reasonable needs.
Retain the transfer and office conditions
Establish a qualifying parent, subsidiary, affiliate or branch relationship, continuing regular business in the United States and at least one other country, and one continuous full-time qualifying foreign year within the relevant preceding three years. Ordinary foreign work may be managerial, executive or specialized knowledge; the U.S. role must meet the requested classification. U.S. visit days do not count toward the foreign year, although brief visits do not automatically break continuity. For L-1A, the U.S. duties must be primarily managerial or executive. A new office means less than one year of qualifying U.S. business activity: the foreign year must specifically be managerial or executive, sufficient premises are needed and the U.S. operation must support that role within one year of approval. Initial new-office approval is at most one year. Owner or major-stockholder cases also need temporary U.S. services and subsequent foreign-assignment evidence.
Describe managerial or executive capacity by function
An L-1A transferee to an established operation may receive up to three years initially, and can extend to a maximum of seven years in total. If the applicant performs hands-on work, identify it and explain who handles the remaining execution tasks. A managerial claim looks at whether the person manages an organisation, department, subdivision, function or component; supervises and controls professional or supervisory staff, or manages an essential function; and exercises discretion over day-to-day operations. The definition also reaches someone who manages an essential function of the organisation, operates at a senior level within it, and has authority over that function rather than merely performing it. In a service operation the honest question is what proportion of the day is spent directing staff or functions and exercising discretion, and what proportion is spent doing the technical work personally. Sequence the review from the foreign payroll and leave history to corporate ownership records, then to US premises, budgets, and the organizational chart. A general manager who will mostly sell product or run a branch counter is not in a managerial role however senior the title. Signing authority and a spending limit describe what may be done; an executive-capacity claim rests on discretion over a major function and supervision flowing through subordinate managers.
