How should we use an EB-5 project's target dates when planning a move?

THE DIRECT ANSWER

Treat project dates as commercial milestones. They do not replace the government's immigration steps, visa availability or the family's individual eligibility assessment.

Maintain a project calendar and an immigration calendar

Place construction, financing and operational milestones in one record and filing or government notices in another. Identify any genuine dependency between them with the reviewer. A change in one calendar should prompt a question, not an assumption that every other date shifts automatically. Keep later removal-of-conditions responsibilities in the plan as well; receiving conditional residence is not the end of all required immigration work.

Escrow and administrative charges, subscription fees, legal work on the petition, translations of financial records spanning several countries, medical examinations, and the consular or adjustment steps for each family member all fall at different points. Two-year conditions also cover a qualifying spouse and children who are unmarried and younger than 21, or a child who remains under 21 for immigration purposes after any applicable Child Status Protection Act calculation; payment timing neither starts nor completes Form I-829.
